These Terms and Conditions govern your use of designburst.ie and any services provided by DesignBurst. By using this website or engaging our services, you agree to these terms. Please read them carefully.

1. About DesignBurst

DesignBurst is a web design studio based in Navan, Co. Meath, Ireland. We provide WordPress website design, development, accessibility, SEO, and ongoing maintenance services to clients across Ireland, the EU, and Australia.

2. Use of This Website

You may use this website for lawful purposes only. You must not:

  • Use the site in any way that breaches applicable laws or regulations
  • Use the site to transmit unsolicited commercial communications
  • Attempt to gain unauthorised access to any part of the site or its systems
  • Reproduce, duplicate, or copy any content from this site without permission

 

3. Services

When you engage DesignBurst for web design or related services, a separate written proposal or agreement will be provided. That agreement, together with these Terms, forms the basis of our contract with you.

Key points that apply to all projects:

  • The full design fee balance is required before work begins.
  • This balance is not refundable, unless under extenuating circumstances where it is agreed within 4 weeks that the project should not proceed. In these circumstances the payee may be eligible for a partial or full refund depending on the level of work completed, and this amount is at the discretion of DesignBurst. 
  • Two rounds of revisions are included as standard unless otherwise agreed
  • Timelines depend on the prompt supply of content, feedback, and approvals from the client
  • DesignBurst retains the right to showcase completed work in our portfolio unless a written request is made otherwise prior to project commencement

 

4. Intellectual Property

Upon receipt of full payment, ownership of the final website design and custom code created for your project transfers to you. You own your website.

DesignBurst retains the right to use the completed work for portfolio and promotional purposes. We also retain ownership of any proprietary tools, templates, or frameworks used in the build that are not specific to your project.

All content on this website — including text, graphics, logos, and audio — is the property of DesignBurst or its content suppliers and is protected by copyright. You may not reproduce any material from this site without written permission. Please email info@designburst.ie if you want to use material from this website.

5. Maintenance and Hosting

Where DesignBurst provides ongoing hosting and maintenance, the terms of that service are set out in a separate maintenance agreement. Maintenance fees are billed monthly (or annually) and are non-refundable once a billing period has commenced.

DesignBurst is not responsible for issues caused by client-made changes to a website outside of an agreed maintenance contract. We offer a variety of management plans and the recurring cost will be detailed prior to project commencement. Website management fees are charged within 6 weeks of the project commencing, regardless of whether the site is live or under construction. 

6. Limitation of Liability

DesignBurst will use reasonable skill and care in providing services. However, we cannot guarantee that the website will be free from errors or interruptions at all times, or that it will meet every specific outcome you expect.

To the fullest extent permitted by Irish law, DesignBurst's liability for any claim arising from our services is limited to the total fees paid for the specific project giving rise to the claim.

DesignBurst is not liable for any loss of business, revenue, profits, data, or indirect losses arising from use of your website.

7. Third-Party Services

We may recommend or integrate third-party tools and services (such as booking systems, payment processors, or CRM platforms). DesignBurst is not responsible for the performance, security, or terms of third-party services.

8. Governing Law

These Terms are governed by the laws of Ireland. Any disputes will be subject to the exclusive jurisdiction of the Irish courts.

9. Changes to These Terms

We may update these Terms from time to time. The date at the top of this page will reflect the most recent revision. Continued use of this website after any changes constitutes acceptance of the updated terms.
